1. Acceptance of Terms

By accessing and using Aleph Safe, operated by Aleph Safe (Pty) Ltd (Registration No. 2026/714988/07), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Aleph Safe for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. Under this license you may not modify or copy the materials, use the materials for any commercial purpose or for any public display, attempt to decompile, reverse engineer, or disassemble any software contained on Aleph Safe, remove any copyright or other proprietary notations from the materials, transfer the materials to another person, mirror the materials on any other server, violate any applicable laws or regulations, or interfere with the operation or security of the service.

3. Disclaimer

The materials on Aleph Safe are provided on an 'as is' basis. Aleph Safe (Pty) Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Aleph Safe (Pty) Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations of Liability

In no event shall Aleph Safe (Pty) Ltd, Aleph Consolidated (Pty) Ltd, their group companies or their suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Aleph Safe, even if any of them or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of Materials

The materials appearing on Aleph Safe could include technical, typographical, or photographic errors. Aleph Safe (Pty) Ltd does not warrant that any of the materials on its website are accurate, complete, or current. Aleph Safe (Pty) Ltd may make changes to the materials contained on its website at any time without notice. However, Aleph Safe (Pty) Ltd does not make any commitment to update the materials.

6. Materials and Content Ownership

The materials on Aleph Safe, including but not limited to text, software, photographs, and other graphics, are the property of Aleph Consolidated (Pty) Ltd, which licenses them to Aleph Safe (Pty) Ltd for operation of the service, or of its content suppliers. You are granted a limited license only, subject to the restrictions in these terms of service. The license is non-exclusive, non-transferable, and subject to the following restrictions: You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute in any way the content, or create derivative works or materials that infringe any copyrights, trademarks, or other proprietary information rights. You may not use any content for commercial purposes.

7. Documents Generated

Documents generated through Aleph Safe are provided based on your input and are designed to assist with safety compliance. However, we make no warranty that generated documents will meet all regulatory requirements. You are responsible for the review and verification of all generated content and you should consult with qualified safety professionals for compliance advice. We do not assume liability for errors, omissions, or misinterpretation of regulations, and generated documents remain your responsibility to use and maintain.

8. Links

Aleph Safe (Pty) Ltd has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Aleph Safe (Pty) Ltd of the site. Use of any such linked website is at the user's own risk.

9. Modifications to Terms

Aleph Safe (Pty) Ltd may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts located in Johannesburg, South Africa.

11. Subscription and Invoices

Payment Terms

By subscribing to a paid plan, you authorize Aleph Safe (Pty) Ltd to charge your payment method on a monthly or annual basis, as selected. Billing cycles begin on the date you subscribe and renew on the same date each month or year.

Payments are processed by Paystack. Depending on which of our group merchant accounts processes the transaction, the charge may appear on your statement as Aleph Technologies (Pty) Ltd or Aleph Safe (Pty) Ltd. Both are companies in the Aleph group and either entry refers to your Aleph subscription.

Aleph Safe (Pty) Ltd is not currently registered for VAT, so no VAT is charged and invoices show a zero VAT amount.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation is effective at the end of the current billing cycle. No refunds are provided for partial months or years.

Refund Policy

Aleph Safe (Pty) Ltd offers a 14-day money-back guarantee on a first subscription. If you email hello@alephsafe.co.za within 14 days of your first payment we will refund that payment in full, without requiring a reason. The guarantee applies once per company. After 14 days no refunds are provided, but you may cancel at any time and keep access until the end of the period you have paid for.

Access ends when the refund is requested, not when the money arrives: once a refund is started, the subscription it paid for is closed and capturing and reporting stop. The money is returned to the card you paid with, and our payment processor takes 3 to 10 business days to place it back on your account. That timing is set by the card networks and your bank, and is outside our control. Your data is retained and becomes available again if you take out a plan later.

Price Changes

Aleph Safe (Pty) Ltd reserves the right to change subscription prices at any time. Price changes will take effect on your next billing date. We will notify you via email at least 30 days before any price change.

12. User Responsibilities

You agree to use Aleph Safe only for lawful purposes and in compliance with all applicable laws. You must not impersonate any person or entity, transmit any harmful, malicious, or defamatory content, or attempt to gain unauthorized access to any portion of the service. You agree not to interfere with the operation of the service or other users' access. Furthermore, you must maintain the confidentiality of your login credentials, be responsible for all activity under your account, and thoroughly verify all generated documents for accuracy and compliance before use.

13. Intellectual Property Rights

Your input data, including your scope of work and project details, as well as any feedback you provide, remain your property. However, by using Aleph Safe, you grant us a license to use this data to improve our service and train our AI models. Generated documents are provided for your use under the terms of this agreement, but you may not redistribute or resell generated documents without our explicit permission.

14. Termination

Aleph Safe (Pty) Ltd may terminate your access to the service at any time, without notice, for violation of these terms or for any reason at its sole discretion. Upon termination, your right to use the service will immediately cease, and we may delete your account and associated data.
